1. Agreement

By accessing or using ActivationKit ("the Service"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these terms.

2. Description of Service

ActivationKit provides an AI-powered user guidance platform. The Service includes an embeddable SDK, API, and management dashboard. The SDK is installed on your application via a script tag and provides real-time guidance to your end users.

3. Accounts

You must create an account to use the Service. You are responsible for maintaining the security of your account credentials and API keys. You must notify us immediately of any unauthorized access.

You are responsible for all activity that occurs under your account, including SDK usage and API calls made with your API key.

4. Pricing and Payment

ActivationKit offers a free tier and paid subscription plans. Paid plans are billed monthly via Stripe. Prices are listed on our pricing page and may change with 30 days' notice.

Free plan: 25 AI conversations per month, unlimited MAU. No credit card required.

Paid plans: Charges begin immediately upon subscription. You may cancel at any time; access continues through the end of the current billing period.

5. Acceptable Use

You agree not to:

Use the Service to violate any applicable law or regulation
Reverse engineer, decompile, or disassemble the Service
Attempt to gain unauthorized access to the Service or its systems
Use the Service to transmit malware or malicious code
Resell or redistribute the Service without written permission
Exceed rate limits or abuse API endpoints

6. Your Data

You retain ownership of all data you submit to the Service, including your application's page structure data and configuration. We claim no intellectual property rights over your content.

You grant us a limited license to process your data solely for the purpose of providing the Service (schema building, AI guidance generation, analytics).

7. Intellectual Property

The Service, including its AI models, decision pipeline, SDK, and documentation, is the intellectual property of ActivationKit. These Terms do not grant you any rights to our trademarks, logos, or proprietary technology beyond what is necessary to use the Service.

8. Availability and Support

We strive to maintain high availability but do not guarantee uninterrupted service. We provide support via email and Discord on a reasonable-efforts basis. Paid plans receive priority support.

9. Limitation of Liability

To the maximum extent permitted by law, ActivationKit shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total liability for any claim arising from the Service is limited to the amount you paid us in the 12 months preceding the claim.

10. Termination

Either party may terminate the agreement at any time. Upon termination, your access to the dashboard will be revoked and SDK guidance will cease. We will retain your data for 30 days after termination to allow for export, after which it will be permanently deleted.

11. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or dashboard notification at least 30 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance.
